I see what is going on, you are looking for posts in the future. WordPress is marking these posts automatically with the post_status of 'future'.
Since you query is looking for post_status 'publish' or 'private' then its not returning any posts.
You shouldn't have any problems updating, there are no known problems since the release. However, it always good to back up just in case.
